Terms of Service
IMPORTANT LEGAL NOTICE
FamilyWill provides a self-service document generation tool that assists users in creating will templates based solely on the information they enter.
FamilyWill does NOT provide legal advice, estate planning advice, or solicitor services.
By using this service, you acknowledge that you are fully responsible for reviewing, validating, and properly executing any document produced.
Effective Date: April 24, 2025
These Terms of Service ("Terms") govern your use of the FamilyWill website and services. FamilyWill is a trading name of JJH Solutions Limited, a company registered in England and Wales (company number 13898562) ("we", "us", or "our").
Please also review our Privacy Policy, which explains how we process personal data.
1. Nature of the Service
FamilyWill provides an automated, self-service platform that allows users to generate will document templates using predefined logic and artificial intelligence tools.
The service does not involve human legal review, solicitor oversight, or personalised legal advice.
2. Simple Wills Only and Suitability
FamilyWill is designed for straightforward wills only. Before you start, we may ask a short set of suitability questions to help confirm whether the service is appropriate for your circumstances. If your answers indicate that the service may not be suitable, you will not be able to proceed.
You are responsible for ensuring that this service is suitable for your needs and for seeking professional advice where appropriate.
3. No Solicitor–Client Relationship
Use of FamilyWill does not create a solicitor–client, advisor–client, fiduciary, or professional relationship of any kind.
4. AI Usage and Limitations
Artificial intelligence is used solely as a technical tool to:
- Structure your inputs into a document format
- Apply standardised wording and formatting rules
- Provide general, non-advisory guidance prompts within the product
We make no guarantee as to the accuracy, completeness, or suitability of any AI-generated content. AI outputs are generated automatically based on general templates and logic. They do not account for your individual legal, financial, or personal circumstances.
You must independently review and verify all output and seek professional advice where appropriate. Do not rely on AI guidance as a substitute for qualified legal advice.
5. User Responsibilities
You are solely responsible for:
- The accuracy and completeness of all information you enter
- Reviewing the generated document for correctness and suitability
- Ensuring the will complies with applicable law in your jurisdiction
- Proper execution, witnessing, and signing of the will in accordance with legal requirements
- Seeking professional legal advice where appropriate
- Keeping your will up to date if your circumstances change
6. Delivery, Downloads, and Storage
Once your will document is generated, it will be made available to you to download. You are responsible for saving, backing up, and securely storing your will document.
In line with our data-minimisation approach, we do not intend to retain copies of your will content or final will document once the service has been delivered. If you delete your will-related data or it is removed under our retention approach, it cannot be recovered.
7. Intellectual Property
All platform software, branding, and content (excluding your input data) are owned by or licensed to JJH Solutions Limited.
8. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so. Subject to that, to the fullest extent permitted by law, we disclaim liability for any loss or damage arising from:
- Use of or reliance on generated documents
- Errors, omissions, or inaccuracies in output
- Failure to properly execute or witness a will
- Changes in law or personal circumstances
- Your failure to seek appropriate professional advice
- Your failure to save or securely store your will document
Our total liability for claims arising out of or in connection with the service shall not exceed the amount paid by you for the service (if any), except where such limitation is not permitted by law.
9. No Warranty
The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, uninterrupted, or that any documents generated will be suitable for your specific circumstances or legally effective.
10. Indemnification
You agree to indemnify, defend, and hold harmless JJH Solutions Limited and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the service; (b) any information you provide through the service; (c) your failure to properly execute, witness, or store your will; (d) any breach of these Terms; or (e) your violation of any applicable law or the rights of any third party.
11. Dispute Resolution
If you have a concern or dispute about the service, please first contact us at info@familywill.co.uk so we can attempt to resolve it informally. We will make reasonable efforts to address your concern within 14 days. If informal resolution is unsuccessful, any legal proceedings must be brought in the courts of England and Wales.
